But the path to achieving this dream isn’t always easy, especially for immigrants navigating the complexity of our legal system and cultural shifts. Today, we hear from Daven Ghandi, an immigration attorney whose journey from Malaysia to the United States. His story offers a unique perspective on the immigrant experience and the realities of pursuing your dreams in a new land.
Growing Up in Malaysia: Privilege and Disadvantage
Daven’s upbringing in Malaysia was a mix of privilege and disadvantage. As an Indian Malaysian, he was part of a minority group facing systemic inequalities. Malaysia’s affirmative action policies, unlike those in the U.S., favor the Malay majority, limiting opportunities for minorities in education and employment.
Despite these challenges, Daven acknowledges his privileged access to private education, which provided him with a strong foundation and the opportunity to study abroad. This contrast highlights the disparities within Malaysian society, where many individuals from similar backgrounds lack the same access to resources and opportunities.
Growing up in a multicultural environment, Daven became fluent in multiple languages, including Malay, Tamil, and a Chinese dialect. This linguistic versatility proved invaluable when he later moved to the U.S. and traveled through Latin America, learning Spanish and adapting to new cultures. And this is common for many of my guests – they learn multiple languages before arriving to the U.S. – once they are here, English may be their 3rd or 4th language.
Choosing America: A Quest for Self-Discovery
At 18, Daven made the brave decision to move to the United States for his studies. Unlike many of his classmates who chose Australia or the UK, Daven sought a completely new experience. He wanted to go somewhere where he knew no one. This desire for self-discovery led him to an education conference in Malaysia, where he met a representative from the University of Wisconsin-Eau Claire.
Drawn to the promise of experiencing a different way of life, Daven was accepted to the university. Within months, he found himself on a plane to Wisconsin, ready to embrace the challenges and opportunities that awaited him.
Culture Shock in Wisconsin: Snow, Language, and Nudity
Arriving in Wisconsin, Daven experienced several culture shocks. The first, of course, was the snow. He had never seen snow before. Beyond the weather, he was surprised by Americans’ assumption that he didn’t speak English fluently. People often spoke to him slowly and deliberately. A stark contrast to his upbringing, where English was commonly spoken at home.
Another significant adjustment was the overwhelmingly white Caucasian population at his university. Being one of the few students of color, he was often mistaken for other brown students. He saw it as an opportunity to push himself to meet new people. Finally, the open nudity in locker rooms was quite the surprise. Despite these initial shocks, Daven embraced his new life, shaped by American movies and TV shows he had grown up watching.
From Student to Immigration Attorney: A Winding Path for Daven Ghandi
Daven’s journey from international student to immigration attorney was filled with twists and turns. After graduating from the University of Wisconsin-Eau Claire, he gained a year of work authorization through the Optional Practical Training (OPT) program. During this time, he completed an internship with a human rights organization in California and later worked at the University of Minnesota Human Rights Center.
Following his OPT, Daven pursued law school and obtained another year of OPT after graduation. He then made the pivotal decision to move to New York City.
Serendipity in the Big Apple
In New York, Daven’s path took an unexpected turn. While studying for the bar exam, he reconnected with a judge he had met years earlier at a conference in Puerto Rico. This chance encounter led to a clerkship opportunity. After passing the bar, he worked for an immigration law firm, gaining valuable experience in the field.
However, his journey faced a significant hurdle when his employer was unable to sponsor him for an H1B work visa due to salary constraints. This setback forced Daven to reevaluate his options and consider alternative paths to achieving his long-term goals.
A Transformative Detour: Guatemala
Seeking guidance and inspiration, Daven sought advice from fellow attorneys. One suggestion changed his life: to immerse himself in the culture and experiences of his clients. Given that many of his clients were from Central America, he decided to move to Guatemala. There, he aimed to deepen his understanding of the socioeconomic and political issues driving immigration.
Daven’s time in Guatemala proved transformative. He volunteered with nonprofits, visited impoverished communities, and learned firsthand about the challenges faced by Guatemalans. He also fell in love with the country’s culture and the warmth of its people. After several months, he returned to the U.S. with a renewed sense of purpose and a deeper connection to his clients’ stories.
H1B Lottery Luck
Back in the U.S., Daven secured a job with an employer who agreed to sponsor him for an H1B visa. This visa allows foreign workers to stay in the U.S. for six years. The catch? The H1B visa is subject to an annual lottery due to high demand. With over 300,000 applicants vying for 85,000 available visas, the odds were stacked against him.
The odds were in his favor because Daven was selected in the lottery. His employer sponsored him, allowing him to continue his legal career in the U.S. More than just luck, this event shows the uncertainty of the immigration system, but more importantly, the power of perseverance and determination.

Challenges and Rewards of Immigration Law
As an immigration attorney, Daven faces both challenges and rewards. One of the most difficult aspects of his job is dealing with the emotional toll of deportation cases. He sees the despair in his clients’ eyes as they face the possibility of being separated from their families and communities.
Despite these challenges, Daven finds immense satisfaction in helping his clients achieve their immigration goals. He enjoys working with children, survivors of abuse, and LGBTQ+ individuals. He loves to help them find safety and freedom in the U.S. Seeing his clients thrive and build successful lives is the ultimate reward.
Immigrant Entrepreneurship: Building Businesses, Building Lives
Daven observes that many of his clients aspire to start their own businesses once they obtain legal status. With the freedom to pursue their entrepreneurial dreams, immigrants contribute significantly to the U.S. economy and enrich their communities with their unique talents and perspectives. According to the Small Business Administration (SBA), immigrants are nearly twice as likely to start a business as native-born Americans. They account for roughly 25% of all entrepreneurs in the United States.
